The NJ Department of Health, Public Health and Food Protection
Program is reminding local health departments that on November 4, 2021,
P.L.2020, c.117 (C.13:1E-99.126 et al.) became effective. The SUPS law
required that all food service businesses including any restaurant, café, deli,
coffee shop, convenience store, grocery store, vending truck or cart, food
truck, movie theater, or business or institutional cafeteria only provide a
single-use plastic straw to a customer upon the request of the customer.
In addition, the food service business is required to maintain an adequate
supply of single-use plastic straws to provide at the request of customers.
The law designates Department of Health as the enforcement agent
for SUPS and also requires the Department to provide a written evaluation
report to the Plastics Advisory Council regarding the food service businesses’
compliance with the requirements. As such, the Department will maintain a
database for plastic straw complaints and will forward the complaints to the
appropriate local health department for their investigation and enforcement as
